From the inviolable home to the impentrable factory: a critical analysis of the jurisprudential expansion of the concept of domicile

Abstract

Case law has extended the constitutional protection of the home (originally intended for private residences) to business premises, granting them a level of inviolability comparable to that of a private dwelling. This has significant practical consequences: the Labour Inspectorate must obtain judicial authorization before entering workplaces, which delays immediate intervention. Such delays facilitate the concealment of violations and the manipulation of evidence, thereby undermining the effectiveness of labour inspections. They also create zones of impunity in which companies, shielded by this fundamental right, may evade oversight, leaving labour rights such as workplace safety, equality, and other worker protections more vulnerable.
