Sociedad digital y transformación algorítmica del Estado: fundamentos conceptuales y jurídicos para el análisis de la inteligencia artificial en la sanidad pública

Resumen

Este artículo examina los orígenes y el desarrollo de la IA en la sociedad digital, destacando su transición hacia una herramienta ampliamente accesible con importantes implicaciones para todos los ámbitos de la sociedad. Se presta especial atención a los desafíos legales que plantea el uso de la IA en la sanidad pública, incluyendo la transparencia, la protección de datos, el sesgo algorítmico y la responsabilidad por los daños causados por sistemas automatizados.El estudio analiza los enfoques internacionales y europeos para la gobernanza de la IA, incluyendo iniciativas de las Naciones Unidas, la UNESCO, la Organización Mundial de la Salud. Se analiza marco regulatorio europeo, en particular a la Ley de IA, el RGPD y la Ley de Gobernanza de Datos, que en conjunto crean un modelo de gobernanza de la IA en la atención sanitaria basado en el riesgo y centrado en el ser humano.El análisis se centra en el hecho de que, a pesar de los importantes avances en el desarrollo de la regulación de la IA, persisten desafíos importantes, especialmente en lo que respecta a la fragmentación regulatoria global, la rendición de cuentas por las decisiones algorítmicas y la implementación práctica de las salvaguardias legales. El artículo sostiene que una gobernanza eficaz de la IA en la atención sanitaria requiere no solo innovación tecnológica, sino también mecanismos legales adaptativos, supervisión ética y una cooperación internacional más estrecha.
