The necessary institutionalization of the charism. Bureaucracy and caudillismo during the Franco regime

Abstract

The existence of bureaucrats in any form of political system does not guarantee itself its nature as a rationally organize system in the way of legal domination. For instance, the top group of the Francoist political power was largely occupied by people characterized for being part of the public service, apart from being loyal to the new Regime as well. It would be wrong, however, to attribute to it the characteristics of a rational and modern administration: the meaning of this type of bureaucracy is very different from the strictly political use of it. In order to determine the political essence that operates at the management of Francoism, it is convenient to specify beforehand the decision-making process: on whom does that power fall and under what budgets is it executed?
Some comparisons with the theories supporting this procedure with the theories of domination and legitimacy will offer the real key to the change of some agents of the Regime, concretized in the political-administrative reforms of the 50s and 60s. After these reforms, the acquired legitimacy will be positioned in bureaucratic rationality and procedural laws, without necessarily leading to the establishment of a rule of law or democratic premises.
