The confrontation between the federative and national legal order: the Dani Olmo case

Abstract

This article examines the conflict between federative and state legal systems through the case of Dani Olmo, whose registration was denied due to a breach of Financial Fair Play regulations. The study assesses the reasonableness of such denial under the principle of proportionality, weighing the balance between competition stability and the fundamental rights of professional footballers, particularly the right to work. The conclusion is that the registration ban fails the proportionality test.
